Telecommunications Department

The department is responsible for issues related to legal regulations concerning the electronic communications services market, including telecommunications, development of telecommunications services and networks, as well as services provided by electronic means. At the same time, it prepares and issues opinions on draft legal acts, strategic plans and programmes, as well as cooperates with EU bodies and international organisations.

Tasks of the Department

  1. Handling matters arising from the Telecommunications Law Act:
    1. shaping the conditions for taking up and carrying out telecommunications activities;
    2. conditions of protection of telecommunications services users, including persons with disabilities, with regard to access to telecommunications services;
    3. managing frequencies, orbital resources and numbering;
    4. conditions of data processing in telecommunications and protection of telecommunications secrecy;
    5. security and integrity of telecommunications networks and services;
    6. network traffic management, net neutrality and openness of the Internet;
    7. requirements to be met by radio and telecommunications terminal equipment;
  2. Handling matters arising from the Act on Electromagnetic Compatibility.
  3. Handling matters arising from the Act on Supporting the Development of Telecommunications Services and Networks, in particular concerning strategic supervision and coordination of activities pertaining to support for investments in telecommunications infrastructure, including with the participation of public funds.
  4. Handling matters resulting from the Act on the Conformity Assessment System in the scope concerning telecommunications.
  5. Handling matters resulting from the Act on Rendering Services by Electronic Means, in particular carrying out evaluations and analyses, including analyses of the effectiveness of legal solutions in force and activities, as well as drafting proposals for systemic solutions, including legislative ones.
  6. Cooperating with the European Union bodies and the Member States of the European Union regarding regulation of electronic communications.
  7. Carrying out the tasks of the Minister resulting from the following Acts:
    1. Construction Law – regarding technical conditions to be met by construction works and their location, technical conditions of use of construction works and authorisations in matters of deviations from technical and construction regulations,
    2. Criminal Procedure Code – regarding technical preparation of information systems and networks.
  8. Conducting administrative proceedings in cases falling within the scope of competence the Minister, recognised on the basis of the Act on Public Roads, concerning the exemption of the road administrator from the obligation to build a service duct.
  9. Handling matters pertaining to the process of digitisation of radio and television broadcasting.
  10. Issuing authorisation decisions and notifications.
  11. Handling matters pertaining to the implementation of the National Broadband Plan;
  12. Cooperation with the Council for Digital Affairs in the scope of execution of the Council tasks referred to in Article 17 paragraph 2 of the Act on Computerisation of the Activities of Entities Carrying Out Public Tasks,
  13. International cooperation, including the implementation of the international obligations of the Republic of Poland in the field of telecommunications, in matters arising from the competences of the department, in particular handling matters pertaining to:
    1. cooperation within global and regional international telecommunications organisations, in particular the International Telecommunication Union (ITU), the European Space Agency (ESA) and the European Global Navigation Satellite Systems Agency (GSA);
    2. radio spectrum use policy;
  14. Coordination of the development of broadband networks, including maintaining the sustainability of the “System Project – Measure for the Development of Broadband Internet Access.”
  15. Maintaining the sustainability of the “SIPS – Information System on Broadband Infrastructure and the Broadband Poland website” project.
  16. Monitoring changes occurring in national and EU law regarding the development of broadband networks and the progress of legislative work in this area.
  17. Carrying out tasks within the scope of the first priority axis of the DP OP including cooperation with the Department for Coordination of European Funds referred to in Article 19, paragraph 2 within the scope of the department's substantive competence.
  18. Carrying out the project supporting the implementation of the provisions of Directive 2014/61/EU of the European Parliament and of the Council of 15 May 2014 on measures to reduce the cost of deploying high-speed electronic communications networks into the Polish legal system.
  19. Handling matters pertaining to the supervision of the Minister over:
    1. President of the Office of Electronic Communications;
    2. Institute of Communications – National Research Institute.
