Informing of suspected/adverse effects of electronic cigarettes and refill containers

Pursuant to Article 11(e) of the Act on protection of health against the consequences of the consumption of tobacco and tobacco products, the importer or distributor of electronic cigarettes and refill containers shall establish and maintain a system for collecting information about all of the suspected and adverse effects on human health of these products. Moreover, he shall retain this information, and submit it immediately to the President of the Bureau for Chemical Substances.

We kindly request to submit this information electronically to the following e-mail address: zagrozenia_epap@chemikalia.gov.pl.

The information should contain key details of the product, including its name, batch number, name of the manufacturer, and description/justification of the risk. The submitted information should allow the President to identify the product and the type of risk easily.

Monitoring the market of electronic cigarettes

Pursuant to the provisions of Article 11(d)(4) of the Act on protection of health against the consequences of the consumption of tobacco and tobacco products, the President monitors the development of the market of electronic cigarettes and the development of the market of refill containers, taking into account any evidence indicating that the use of electronic cigarettes and refill containers is a gateway to nicotine addiction, and ultimately to the consumption of tobacco products.

Polish legal acts

Directive 2014/40/EU of the European Parliament and of the Council of 3 April 2014 on the approximation of the laws, regulations and administrative provisions of the Member States concerning the manufacture, presentation and sale of tobacco and related products and repealing Directive 2001/37/EC was transposed to the Polish law by the Act of 22 July 2016 on the Amendment of the Act on protection of health against the consequences of the consumption of tobacco and tobacco products (Dz. U. of 2016, item 1331).  

The currently binding consolidated text of the Act on protection of health against the consequences of the consumption of tobacco and tobacco products (Dz. U. of 2019, item 2182).
