Sejm in favour of changes for pensioners born in 1953

The Sejm passed an amendment of the act assuming that persons born in 1953 who had been negatively affected by the introduction of new pension calculation rules in 2013 would have an opportunity to recalculate their pensions and recover decreased benefits. These changes will be favourable for around 74,000 persons. In a majority of cases, the average monthly pension will rise by PLN 202. Now the bill will proceed to the Senate.

In 2013, the rules of calculating the amount of pension for persons drawing an early old-age pension were amended by introducing a less favourable solution. Under the applicable law, the amount of pension payable to persons who have reached the common retirement age should be decreased by the amounts of early old-age pensions paid so far. The problem of decreased benefits refers to persons born in 1953. In March 2019, this provision was questioned by the Constitutional Tribunal.

The amendment adopted by the Sejm should allow citizens to obtain the right to common pension without the use of the mechanism of decreasing the basis of its calculation by the amounts of early old-age pensions drawn beforehand. Such a possibility will be available to insured persons born in 1953 who had applied for common pension to the Social Insurance Company (ZUS) before the Constitutional Tribunal passed the said judgement and those who will submit such an application for the first time.

The act also provides for the reimbursement of the difference between the pension drawn so far and the payable amount of pension, the recalculation of survivors’ pension, and the suspension or discontinuation of proceedings regarding the recalculation of the pension assessment basis that were initiated before the entry of the act into force.

Pensions will be recalculated ex officio by the Social Insurance Company upon lapse of 6 months from the entry of the act into force.

Beneficiaries and conditions: details

The higher pension will be paid to persons born in 1953 who:

  • have drawn or drew early old-age pensions;
  • became entitled to early old-age pension before 1st January 2013;
  • applied at any time for pension according to new rules that is payable when the beneficiary reaches the legal retirement age and this pension was determined with a decrease of the assessment basis by the total amounts of early old-age pensions drawn so far.

It is estimated that these persons will receive an average monthly increase of PLN 202 and a compensation for the decreased pension in the average amount of PLN 12,786. Altogether, 62,600 persons will benefit from this change.

The persons who draw early old-age pensions according to old rules awarded before 2013 and who did not apply for common pension until the judgement of the Constitutional Tribunal and will apply for it in July this year will receive an average monthly increase of PLN 1,487 according to estimations.  Changes in this respect will affect 11,200 persons.
