The end of the first day employment syndrome since 1 September

On 22 June this year, President of the Republic of Poland, Andrzej Duda, signed the amendment to the Labour Code prepared in the Ministry of Family, Labour and Social Policy, which eliminates the first day employment syndrome. 

Thanks to the new regulations, the employer will be obliged to sign a contract with the employee before allowing him or her to work. The regulations will enter into force on 1 September 2016.

 

Currently applicable provisions allow employers to attend to contract formalities by the end of the first day of work. This allowed postponing them, and in case of an inspection explaining that it is the first day of employment, so the statutory deadline for the conclusion of the contract has not passed yet.

 

The change is to prevent such practice and allow employees to full enjoy their employment rights from the beginning of work.
