LAS TARIFAS DE ESTUDIOS EN CASO DE NO OBTENER UNA VISA PARA ENTRAR EN POLONIA CON EL FIN DE EMPEZAR O CONTINUAR ESTUDIOS / INFORMATION ABOUT REFUNDING STUDENT FEES IN CASE OF RECEIVING A VISA REFUSAL IN ORDER TO START OR CONTINUE STUDIES

Las condiciones para el cobro de tasas por los servicios educativos por parte de las universidades públicas se establecen en la Ley de 20 de julio de 2018 sobre ka Educación Superior y Ciencia, y en el caso de las universidades no públicas, resultan de la normativa interna de esas universidades. / The charging fees issues for educational services by public universities are regulated in the Act of 20 July 2018, Law on Higher Education and Science, and in the case of non-public universities, they result from the internal regulations of these universities.

Los estudiantes celebran convenios con universidades, cuyas disposiciones contienen condiciones detalladas relacionadas con el proceso de admisión, el curso de estudios, incluidas las disposiciones sobre el monto de las tasas y las reglas para el reembolso de las tasas pagadas. Los candidatos a estudios deben leer estos documentos en detalle, en particular con las disposiciones sobre las reglas para obtener el reembolso de las tasas de matrícula pagadas.

Los problemas de reembolso se tratan directamente entre los estudiantes y las universidades. El Ministerio de Relaciones Exteriores de la República de Polonia, la Embajada de la República de Polonia, así como los Consulados de la República de Polonia no median en los contactos entre el estudiante y la universidad, ni tienen herramientas legales que permitan a un extranjero a quien se le ha negado una visa de estudiante obtener un reembolso de las tasas de matrícula pagadas.

Si la universidad no cumple con las disposiciones del contrato celebrado con el estudiante, y en particular no ha reembolsado la tarifa en el caso de que el contrato así lo dispusiera, las reclamaciones relativas a las tarifas de los estudiantes sólo podrán tramitarse de acuerdo a la ley civil.

Students conclude civil law contracts with universities, which contain special conditions related to the admission process, the course of studies, as well as provisions regarding the amount of the fees and the rules related to the fee refunds. Candidates for studies should carefully study these documents in detail, in particular the provisions on the rules for obtaining the refund of the paid tuition fees.

Refund issues are settled between students and universities. The Ministry of Foreign Affairs of the Republic of Poland, the Embassies of the Republic of Poland, as well as the Consulates of the Republic of Poland do not mediate in issues between the student and the university and do not have legal measures allowing a foreigner, who has been refused a student visa, to obtain a refund of the tuition fees.

If the university fails to comply with the provisions of the contract concluded with the student, in particular, it has not refunded the fee, claims regarding student fees may only be pursued through civil law.
