Change in the rules of issuing temporary protection certificates

Beginning on January 25th, certificate on temporary protection can be obtained solely based on a written application followed with the submission of the required documents. This relates to foreigners who are not Ukrainian citizens who arrived from Ukraine to Poland after February 24th and who meet the requirements set out in the EU Council’s Implementing Decision.

Foreigners not covered by the Act on assistance to Ukrainian citizens in connection with the armed conflict on the territory of the country listed as displaced persons described in the EU Council’s Implementing Decision stating the influx of persons displaced from Ukraine are allowed to apply for temporary protection in Poland (on the principles defined in the Act on assistance to Ukrainian citizens in connection with the armed conflict on the territory of Poland). In such case, temporary protection is confirmed by a certificate issued by the Office for Foreigners.

Beginning on January 25th, the declarations for issuing the certificate may be filed (the template for the declaration can be downloaded below):

  • by mail to: Urząd do Spraw Cudzoziemców (Office for Foreigners), Taborowa 33, 02-699 Warsaw, Poland,
  • by e-mail to: ochronaczasowa@udsc.gov.pl,
  • electronically through ePUAP,
  • personally in the Office’s registry office at Taborowa 33 in Warsaw.

Foreigners must attach the following documents to the application:

  1. a copy of a travel document with the confirmation of entry to Poland as at 24.02.2022.
  2. a copy of a document confirming the right for protection or a legal stay in Ukraine based on a valid certificate for permanent residence,
  3. a declaration on the lack of possibility to return to the country or region of origin,
  4. copies of documents regarding relationships with persons eligible for temporary protection in the case of children or other close relatives who lived together a single family.

An employee of the Office will contact the foreigner and book a date for the personal collection of the certificate. The original copies of the documents attached to the application must be presented upon the collection of the certificate. The certificate will be issued only after the original copies are validated with the originals.

In cases when the resident does not qualify for the temporary protection, the declaration regarding the case will be issued by mail or through ePUAP.
