Prokuratura Okręgowa w Sosnowcu

1 Wydział Śledczy Prokuratury Okręgowej w Sosnowcu, na podstawie art. 131 § 2 i 3 kodeksu postępowania karnego,  zawiadamia wszystkich pokrzywdzonych o tym, że postanowieniem z 6 lipca 2026 roku umorzono śledztwo o sygnaturze 3048-1.Ds.10.2026 w sprawie sprowadzenia w dniu 10 stycznia 2026 roku bezpośredniego niebezpieczeństwa katastrofy w ruchu powietrznym, polegającego na spowodowaniu – w przestrzeni powietrznej nad miejscowością Czeladź (województwo śląskie) – zderzenia samolotu pasażerskiego linii Wizz Air, model Airbus A321 Neo o numerze 9H-WAD, z nieustalonym obiektem o wyglądzie balonu, to jest o czyn z artykułu 174 § 1 kodeksu karnego.
Postępowanie dotyczyło zdarzenia zaistniałego w trakcie przelotu o numerze W6 1352, realizowanego na trasie Sewilla – Warszawa.
Podstawę umorzenia stanowił stwierdzenie, iż brak jest danych dostatecznie uzasadniających podejrzenie popełnienia czynu.
Druk pouczeń o uprawieniach i obowiązkach pokrzywdzonego – w języku polskim oraz w języku angielskim – dostępny jest w załączniku do niniejszego komunikatu.

Artykuł 131 §  2 kodeksu postępowania karnego
Jeżeli w sprawie ustalono tylu pokrzywdzonych, że ich indywidualne zawiadomienie o przysługujących im uprawnieniach spowodowałoby poważne utrudnienie w prowadzeniu postępowania, zawiadamia się ich poprzez ogłoszenie w prasie, radiu, telewizji lub na stronie internetowej sądu albo prokuratury.

Jeżeli istnieje obowiązek doręczenia postanowienia, przepis § 2 stosuje się odpowiednio. Należy jednak zawsze doręczyć je temu pokrzywdzonemu, który w zawitym terminie 7 dni od dnia ogłoszenia o to się zwróci.

Notice of discontinuation of investigation file no. 3048-1.Ds.10.2026
The Investigation Division of the Circuit Prosecutor’s Office in Sosnowiec, acting pursuant to Article 131 § 2 and 3 of the Polish Code of Criminal Procedure, hereby notifies all injured parties that, by decision dated 6 July 2026, the investigation file no. 3048-1.Ds.10.2026 concerning the creation, on 10 January 2026, of an immediate danger of an air traffic disaster, consisting in causing, within the airspace over the town of Czeladź (Silesian Voivodeship), a collision between a Wizz Air passenger aircraft, Airbus A321neo, registration 9H-WAD, and an unidentified object resembling a balloon, i.e. an offence under Article 174 § 1 of the Polish Criminal Code, has been discontinued.
The proceedings concerned an incident that occurred during flight W6 1352, operated on the Seville – Warsaw route.
The grounds for the discontinuance were the finding that the evidence obtained does not provide sufficient grounds to justify a reasonable suspicion that a criminal offence has been committed.

Article 131 § 2 of the Polish Code of Criminal Procedure
Where the number of injured parties identified in the proceedings is such that serving each of them individually with information regarding their procedural rights would seriously impede the conduct of the proceedings, notification shall be effected by means of an announcement published in the press, broadcast on radio or television, or posted on the website of the competent court or prosecutor’s office.

Where there is an obligation to serve the decision, the provisions of § 2 shall apply accordingly. However, the decision shall in every case be served upon any injured party who requests such service within the non-extendable period of 7 days from the date of publication of the announcement.
