Personal Data Processing Policy

NOTICE ON THE PROCESSING OF PERSONAL DATA AT THE MINISTRY OF AGRICULTURE AND RURAL DEVELOPMENT

As required by Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation, “GDPR”), we inform you about the rules governing the processing of your personal data, and about the related rights you may exercise.

1. The controller of your personal data processed at the Ministry of Agriculture and Rural Development is the Minister of Agriculture and Rural Development.

3. The controller shall process your personal data on the basis of applicable law, in connection with the performance of tasks carried out in the public interest or in the exercise of official authority vested in them, as well as pursuant to previously concluded contracts and based on your consent.

4. Your personal data shall be processed for:

  1) the fulfilment of legal duties incumbent on the Ministry of Agriculture and Rural Development;
 2) the performance of contracts;
 3) the purpose specified in the consent form in other cases, and solely within the scope of and based on said prior consent.

5. In connection with the processing of data for the purposes referred to in Section 4 above, the recipients of your personal data may be:

  1) public authorities and entities that carry out public tasks or act on behalf of public authorities – within the scope and for the purposes arising from generally applicable law;
 2) other entities which, pursuant to relevant agreements executed with the Ministry of Agriculture and Rural Development, process personal data, for which the controller is the Minister of Agriculture and Rural Development.

6. Your personal data shall be stored for the period necessary to achieve the objectives referred to in Section 4, and thereafter for the period and within the scope required by generally applicable laws.

7. With respect to the processing of your personal data you have the following rights:

  1) right of access to your personal data, including the right to obtain a copy thereof;
 2) right to rectification (correction) if your personal data are inaccurate or incomplete;
 3) right to erasure (right to be forgotten) where:

a) the personal data are no longer necessary in relation to the purposes for which they were collected or otherwise processed;
b) the data subject objects to the processing of their personal data;
c) the data subject has withdrawn consent on which the processing is based, and where there is no other legal ground for the processing;
d) the personal data are unlawfully processed;
e) the personal data have to be erased in order to comply with a legal obligation;

  4) right to restriction of processing where:

 a) the accuracy of the personal data is contested by the data subject;
 b) the processing is unlawful and the data subject opposes the erasure of the data and requests their restriction instead;
c) the controller no longer needs the data for their own purposes, but the data are required by the data subject for the establishment, exercise or defence of legal claims;
d) the data subject has objected to processing of their personal data, pending the verification whether the legitimate grounds of the controller override those of the data subject;

  5) right to data portability, where all the following conditions shall be met:

a) the processing of personal data is based on a contract executed with the data subject or on a consent they have given;
b) the processing is carried out by automated means;

  6) right to object to data processing, where all the following conditions shall be met:

a) there are grounds to object relating to your particular situation if the data are processed for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller;
b) processing is necessary for the purposes of the legitimate interests pursued by the controller or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data, in particular where the data subject is a child.

8. In cases where your personal data are processed based on your consent (Article 6(1)(a) GDPR), you may withdraw your consent at any time. The withdrawal shall not affect the lawfulness of processing based on consent before its withdrawal.

9. In cases where your personal data are processed based on your consent, you provide your personal data to the controller voluntarily.

10. It is mandatory for you to provide your personal data when the basis of the processing of personal data is a provision of law or a contract between the parties.

11. Should you learn that the Ministry of Agriculture and Rural Development processes your personal data unlawfully, you may lodge a complaint with a supervisory authority competent for personal data protection (the President of the Personal Data Protection Office, ul. Stawki 2, 00-193 Warszawa).

12. Your personal data may be processed by automated means but shall not be subject to profiling.

13. There is a surveillance system in place at the Ministry of Agriculture and Rural Development. Surveillance is used within the legitimate interests of the controller to protect property and ensure security. In this case, the source of data are the surveillance cameras. The recipients of your personal data recorded by those means shall only be those entities which are authorised to receive personal data under the law. Surveillance data shall be processed for the period and within the scope required by generally applicable law.

14. A person recorded by the Ministry’s surveillance system, shall have the right to request from the controller access to, rectification, erasure, or restriction of processing of their personal data. A person recorded by the surveillance system shall have the right to lodge a complaint with the supervisory authority.

15. Information concerning the means and scope of the processing of your personal data with respect to the performance of the respective tasks carried out by the controller is available under thematic tabs at the website of the Ministry of Agriculture and Rural Development, as well as in documents and correspondence relating to the performance of the respective tasks.
