Termination of the contract of employment by notice

Termination of the contract of employment by notice is a declaration of intent of one of the parties to the employment relationship, aimed at terminating the employment relationship at the end of the period referred to as the notice period.

The declaration of intent is effectively made when it reaches the addressee, that is to say, the other party in such a way as that the addressee can become acquainted with the content of that declaration. This can include handing it directly into the hands of the employee or the employee’s receipt of a mailed letter containing such a document.

The employee’s or employer’s declaration of intent to terminate the contract of employment should be in writing.

The employer’s letter of termination of the fixed-term contract of employment or employment contract for an indefinite period shall contain:

  • the reason for the termination,
  • letter of rights of the employee to appeal against the termination before the labour court.
