INFORMATION ABOUT REFUNDING STUDENT FEES IN CASE OF RECEIVING A VISA REFUSAL IN ORDER TO START OR CONTINUE STUDIES
The charging fees issues for educational services by public universities are regulated in the Act of 20 July 2018, Law on Higher Education and Science, and in the case of non-public universities, they result from the internal regulations of these universities.
Students conclude civil law contracts with universities, which contain special conditions related to the admission process, the course of studies, as well as provisions regarding the amount of the fees and the rules related to the fee refunds. Candidates for studies should carefully study these documents in detail, in particular the provisions on the rules for obtaining the refund of the paid tuition fees.
Refund issues are settled between students and universities. The Ministry of Foreign Affairs of the Republic of Poland, the Embassies of the Republic of Poland, as well as the Consulates of the Republic of Poland do not mediate in issues between the student and the university and do not have legal measures allowing a foreigner, who has been refused a student visa, to obtain a refund of the tuition fees.
If the university fails to comply with the provisions of the contract concluded with the student, in particular, it has not refunded the fee, claims regarding student fees may only be pursued through civil law.

Do I have to apply in person?
Visa application form must be submitted in person. Diplomatic mission does not accept application forms sent via fax, regular mail or e-mail.
How to book an appointment?
In order to apply for a visa, please book your appointment via the e-konsulat system.
Appointments are possible to take every Sunday.
Remember to apply for a visa not later than 15 days before the planned departure.
What documents do I need to submit - general requirements?
1. A visa application form filled via the e-konsulat system, printed and signed;
Please pay attention to select proper application form. For travel for maximum 90 days you should apply for schengen visa type C. For travel above 90 days you should apply for national visa type D. Proper application form is obligatory. Wrongly registered application forms won't be accepted during appointment at the Embassy.
2. A 3.5 x 4.5 cm colour photo. The photo must be:
a. sharp, taken against white background and printed on a quality paper,
b. newer than 6 months,
c. taken en face, clearly showing the eyes and face on both sides from the top of the head to the top of the shoulders with the face covering 70-80% of the photo. The photo must be taken without any headwear.
3. Passport issued within last ten years, valid for at least six months from the expected return date, with at least two blank pages for visas.
4. A copy of the passport page with personal data and the photo.
5. Original Birth Certificate ("shenas-nameh") and National ID Number Card ("cart-e melli"), with a photocopy of all pages and official translation, stamped by the Ministry of Justice of Iran and Ministry of Foreign Affairs of Iran.
6. Proof of travel medical insurance to cover any expenses which might arise in connection with repatriation for medical reasons, urgent medical attention and/or emergency hospital treatment or death, during your stay on the territory of the Schengen countries. The insurance should be valid throughout the territory of all Schengen countries and cover the entire period of the person's intended stay or transit. The minimum coverage should be EUR 30 000. The applicant should submit a written confirmation from the insuring company with information about the name of the insured person, territorial validity of the insurance, exact dates and amount of the coverage. 7. Copy of Residence Permit in Iran (the original residence permit must be shown to the Visa Officer) - applies only for non-citizens of Iran.
8. Proof of sufficient financial means:
Amount of financial means a foreigner is required to have in order to be able to cover the cost of lodging, boarding, travelling through and out of the territory of the Republic of Poland:
- 75 PLN per day
- 2500 PLN additionally if return flight is not purchased
As a document confirming financial means you should provide one of them (they should be issued within last one month):
- the original of the certificate on the amount of limit on the credit card issued by the bank/company, which issued that credit card;
- the original of the certificate on the possession of the financial measures on the account in the bank, which possess his premises on the territory of Poland or other Schengen member state;
- certificate of scholarship
Document on financial means from a sponsor will be also accepted. In such case Non Objection Letter from sponsor as well as sponsor’s passport and visa copy (if applicable), employment certificate with salary information and current bank account statement for the last 3 months should be provided together with proof of a relation between applicant and sponsor (birth certificate).
9. A proof of accommodation (for example: an official invitation, a hotel booking, dormitory reservation or informal invitation of the host with the copy of his/her ID and passport).
10. Documents confirming the purpose of your stay Poland.
11. A flight reservation with a Passenger Registration Number - visa will be issued for the dates given in the airline reservation. The Embassy advises not to pay for airline tickets prior to visa approval in order to avoid financial loss.
Additionally, when applying for a visa for a minor you should present:
- Written consent of the child’s/minor’s parent(s) to apply for a visa, confirmed by a notary. If there is only one guardian, it should be proved by a birth certificate, a court decision on exclusive parental custody or a death certificate of the other parent.
- Originals and copies of parents' passports.
- An original and a copy of a birth certificate.
If the child is entered in the parent's or legal guardian’s passport, please submit a separate visa application. The visa will be pasted into the parent's or the legal guardian's passport.
Please note:
- You must apply for a visa in a consular office or the embassy’s consular department in the consular district of your place of residence
- Usually, the above documents are enough to receive a visa, however, the consul may require additional documents.
- The consul may, but does not have to, invite the applicant for an interview.
- The D-type visas allow to stay in other Schengen states for 90 days of any 180-day period. It means that you can legally stay in the Schengen Area only if your stay was shorter than 90 days over the past 180 days.
- The D-type visa is valid for a maximum of 365 days.
- Please note, that receiving the visa does not guarantee that you will enter Poland - the final decision is always made by the Border Guard.

10. University acceptance letter or certificate of enrollment.
In case of an application for a visa to the first year of studies / foundation course, one must submit the legalized/apostilled higher secondary certificate. The higher secondary certificate MUST include recognition statement on a secondary education certificate confirming the right to apply for admission to first-cycle studies or long-cycle studies issued by NAWA Director or the decision of the competent POLISH education superintendent regarding the recognition of the secondary school leaving certificate abroad as a document confirming the right to apply for admission to higher education in the Republic of Poland.

In case of application for a visa to the second and third cycle studies, applicant must provide the higher studies certificate/diploma of previous graduation.
11. Language proficiency certificate - certificate confirming the student’s language proficiency on a level required by the educational institution, not lower than B2. 12. Proof of payment for studies issued by the university. In case of granted scholarship proof must be provided.

12. Recommendation letter from the employer (company) in Iran - in case of relocation whithin the same company.
13. A current reference letter from the employer in Iran with salary certificate (if applicable). The certificate of employment must specify the date of recruitment, position in the company and salary.

15. In case there is no official invitation registered by the Governor's office in Poland documents prooving current status of inviting person is required, such as: proof of an employment/proof of an ownership of the company, bank statement with tournover for last 3 months indicated

How much does it cost?
Visa fee is 200 EUR, paid by cash during the appointment.
Out of charge:
a) family members of the EU citizen (visas for entry to Poland):
- the spouse of the EU citizen;
- a direct descendant of the EU citizen or his/her spouse, who is under the age of 21 and is dependent on the EU citizen or his/her spouse;
- a direct ascendant of the EU citizen or his/her spouse, who is dependent on the EU citizen or his/her spouse;
b) family members of RP citizen:
- the spouse of the citizen of the Republic of Poland;
- a direct minor descendant of the RP citizen or his/her spouse, who is dependent on RP citizen or his/her spouse;
- a direct ascendant of the RP citizen or the spouse, who is dependent on RP citizen or his/her spouse;
c) holder of the Pole’s Card
The visa application fee is non-returnable, whatever the consul's decision.
Note:
- Embassy of Poland does not cooperate with any visa agenicies for visa process;
- Visa agencies does not result in any form of preferential treatment;
- Only consular officer is entitled to make visa decysion;
- The only required payment for visa procedure is a visa fee.
What is the waiting time?
The decision is made within 15 calendar days from the payment date of application fee. If the documents need to be examined in more detail, the consideration period may be extended to 30 days.
How to collect the documents?
The applicant will be informed either by phone or e-mail when the visa procedure has been finished. In order to collect the documents the applicant should approach the Embassy personally or may authorize others during the submission of the form. Authorized persons should have their ID to collect applicant’s decision. The only exception to this rule is for families travelling together who have applied on the same day. In such cases, one person can collect the decisions.
How to appeal?
If you do not agree with the consul's decision you may ask to have your visa application re-considered. You must apply for the reconsideration in the office that issued the decision within 14 days of its delivery.
