Issuing multilingual standard forms as attachments to National Criminal Register certificates

Following the entry into force of Regulation (EU) 2016/1191 of the European Parliament and of the Council of 6 July 2016 on promoting the free movement of citizens by simplifying the requirements for presenting certain public documents in the European Union and amending Regulation (EU) No 1024/2012, it is possible, as of 16 February 2019, to request a multilingual standard form (hereinafter: the form) as an attachment to a certificate issued by the National Criminal Register.

On 24 May 2019, the Act of 4 April 2019 on the submission of certain official documents in the Member States of the European Union entered into force (Journal of Laws, item 860). It clarified the application of certain provisions of the EU Regulation.

 

Who can obtain a multilingual form?

The form is intended for Polish nationals who intend to submit National Criminal Register certificates of clear criminal record in other EU countries. The form is issued at the request of the person concerned only with regard to information that there are no data of the person in the criminal records of the National Criminal Register.

 

Where can I obtain the form?

A natural person being a Polish national may request the form personally or through an attorney appointed in writing:

  • at the National Criminal Register Information Points operating at common courts of law throughout Poland (list of National Criminal Register Information Points);
  • at the Information Bureau of the National Criminal Register in Warsaw (ul. Czerniakowska 100, 00-454 Warsaw);
  • or via the e-KRK system by creating an account on the Ministry of Justice e-Platform at ekrk.ms.gov.pl.

 

The fee

For issuing a multilingual standard form, a fee of PLN 17 is charged.

The fee must be paid in one of the following ways:

  • To the bank account of the Ministry of Justice (the same account to which fees for National Criminal Register certificates should be paid);
  • In the form of court fee stamps (E-stamp);
  • In cash at the cash desk of the Ministry of Justice;
  • In cash at the courthouse cash desk.

Payments for obtaining the form by electronic means should be made only through the payment mechanisms available via the e-KRK.

 


Remember!

  • A multilingual standard form is only a translation aid of the issued certificate into the chosen official language of the European Union.
  • The multilingual standard form is issued only to Polish nationals.
  • If you need a translation of the certificate from the National Criminal Register in another language, such translation can only be provided by a sworn translator. All such translations are procured by the person concerned.
  • The Information Bureau of the National Criminal Register does not act as an intermediary in submitting documents to the Ministry of Foreign Affairs in order for the requesting person to have the documents apostilled (more information on how to have a document apostilled is available at: https://www.gov.pl/web/dyplomacja/apostille).

 

Additional information:

A request for a multilingual form can be submitted:

  • Together with a request for a certificate from the National Criminal Register; 
  • After the certificate is issued.

If the request is submitted after the certificate from the National Criminal Register has been issued, the requesting person is obliged to submit the already issued certificate. The request must be submitted to the authority that issued the certificate.

 

A request for the form submitted together with the request for an National Criminal Register certificate must include:

  • name and surname of the requesting person;
  • PESEL number, and if it has not been assigned – the date of birth of the person submitting the request;
  • indication of the official language of the EU in which, apart from Polish, the multilingual form is to be drawn up;
  • mailing address (optionally) of the person submitting the request;
  • indication of the name or type of the public document to which the multilingual form is to be attached (in the case of the National Criminal Register it is the certificate);
  • the name and surname of the person concerned by the certificate to which the multilingual form is to be attached.

The request must be accompanied by proof of payment of the fee for issuing a multilingual form, in the amount of PLN 17.

 

A request for the form submitted following issuance of an National Criminal Register certificate must include:

  • name and surname of the requesting person;
  • PESEL number, and if it has not been assigned – the date of birth of the person submitting the request;
  • indication of the official language of the EU in which, apart from Polish, the multilingual form is to be drawn up;
  • mailing address (optionally) of the person submitting the request;
  • date of the certificate to which the multilingual form is to be attached.

The request must be accompanied by proof of payment of the fee for issuing a multilingual form, in the amount of PLN 17.

 

Attorney

If the request for a multilingual standard form is submitted by an attorney appointed in writing, the power of attorney must also include the authority to have the multilingual form issued.
