Amendment to the Act on Sport adopted by the Sejm. New regulations to improve access to some sports facilities

On Friday, 12 September the Sejm unanimously adopted an amendment to the Act on Sport. Thanks to the new solutions, sports facilities such as sports pitches, courts, running tracks, ice rinks, outdoor gyms, skateparks, roller skating rinks and pump tracks will be exempt from noise level standards when used for sporting activities.
The amendment to the Act on Sport was supported by 435 MPs and passed with no one voting against and no abstentions. The amendment will subsequently be considered by the Senate.
According to the draft, the Act on Sport of 25 June 2010 will be extended by Article 38a with the following wording:
“The practice of sport on sports pitches, courts, running tracks, ice rinks, outdoor gyms, skateparks, roller skating rinks and pump tracks shall be considered common use of the environment within the meaning of Article 4(1) of the Act of 27 April 2001 – Environmental Protection Law (Journal of Laws of 2025, item 647), if it takes place as part of sports training or school or recreational sports activities.”
The introduction of the new provision will exclude the applicability of noise level standards set, based on the Act of 27 April 2001 – Environmental Protection Law, for noise generated in connection with the common use of the environment, in the form of:
- sports training;
- school sports activities;
- recreational physical activities.
The amendment to the Act on Sport was initiated by the Minister of Sport and Tourism following the court ruling that restricted the use of the sports pitch in Puławy (Lubelskie Voivodeship) due to noise-related complaints from local residents. This was one of several court rulings in Poland that introduced such restrictions. The new solution aims to prevent similar situations in the future and to ensure access to public sports facilities.
