Senate committees have adopted the Act on the construction of state border protection installations

– The current situation forces Poland to immediately undertake further projects that significantly affect the level of protection of the state border, the external border of the European Union, said Deputy Minister Maciej Wąsik. The Deputy Minister of the Interior took part in today's (26 October) joint meeting of the Committee on Local Self-Government and State Administration and the Committee on Human Rights, the Rule of Law and Petitions of the Senate of the Republic of Poland. The committees dealt with consideration of the Act on the construction of state border security installations.

Poland has already taken many measures aimed at securing the state border, the external border of the European Union, against attempts of illegal crossing, eliminating threats to the security of citizens and ensuring public order

said Deputy Minister Maciej Wąsik.

However, despite all efforts and the great sacrifice made by officers and soldiers, it can be expected that in the coming days and weeks, the number of people attempting to cross the state border illegally will increase, as evidenced by further hybrid actions on the part of the Belarusian side

Therefore, the Council of Ministers decided to adopt and submit a draft law to parliamentary consideration. It aims to prepare and implement an investment consisting of the construction of a barrier. It will serve to secure the state border against an uncontrolled influx of migrants to the territory of Poland

 stated Deputy Minister Maciej Wąsik. 

The Act on the construction of state border protection installations

The Act aims to determine the rules for the construction of the installations at the state border, which also serves as the external border of the European Union. The designed solution creates the legal basis for the fast and efficient implementation of such an investment. Securing the border will include erecting protective devices along with electronic and telecommunications infrastructure. 

The formal investor in the construction of the barrier along the state border will be the Commander in-Chief of the Border Guard.  He will be authorised to appoint a proxy in this matter. A team will also be appointed to prepare and implement the investment, including entities relevant to the entire investment process. 

Given the migration pressure on the Poland-Belarus section of the state border, the Act proposes the creation of mechanisms that will enable the construction of the barrier in the shortest possible time. Therefore, the Act comprehensively regulates these issues.

Due to the extreme urgency of implementing the investment, in the context of existing threats on the state border, the law is to enter into force on the day following the day of promulgation.

Today, the Senate committees adopted the Act without amendments (26 October).
