Informacja dotycząca przetwarzania danych osobowych w zbiorach konsularnych

Zgodnie z art. 13 rozporządzenia Parlamentu Europejskiego i Rady (UE) 2016/679 z 27 kwietnia 2016 r. w sprawie ochrony osób fizycznych w związku z przetwarzaniem danych osobowych i w sprawie swobodnego przepływu takich danych oraz uchylenia dyrektywy 95/46/WE (RODO), informujemy, iż:

1. Administratorem, w rozumieniu art. 4 pkt 7 RODO, Pana/Pani danych osobowych jest Minister Spraw Zagranicznych z siedzibą w Polsce, w Warszawie (00-580), Al. J. Ch. Szucha 23.
2. Konsul RP w Czarnogórze, z siedzibą w Podgoricy wykonuje obowiązki administratora w stosunku do danych zawartych w prowadzonych przez niego zbiorach konsularnych.
3. Minister Spraw Zagranicznych powołał Inspektora Ochrony Danych (IOD), który realizuje swoje obowiązki w odniesieniu do danych przetwarzanych w Ministerstwie Spraw Zagranicznych i placówkach zagranicznych. Funkcję tę pełni Pan Daniel Szczęsny.

4. Dostęp do danych posiadają wyłącznie osoby upoważnione przez Administratora.
5. Dane zawarte w zbiorach konsularnych przetwarzane są na podstawie przesłanek zawartych
   w art. 6 ust. 1 lit. c RODO w celu realizacji przez konsula RP obowiązków wynikających z odrębnych przepisów prawa (wskazanych w tabeli poniżej).
6. Dane podlegają ochronie na podstawie przepisów RODO i nie mogą być udostępniane osobom trzecim, nieuprawnionym do dostępu do tych danych, a także nie będą przekazywane do państwa trzeciego, które nie spełnia gwarancji ochrony co najmniej równorzędnej do tej przewidzianej przepisami RODO. Dane mogą być przekazane do państwa trzeciego wyłącznie w przypadku, gdy obowiązek taki określony jest w prawie polskim lub prawie Unii Europejskiej, zgodnie z przepisami art. 44 - 46 RODO.
7. Pani/Pana dane mogą być udostępnione właściwym podmiotom, w tym organom publicznym, na podstawie przepisów prawa. 
8. Podanie przez Panią/Pana danych osobowych jest wymogiem ustawowym oraz jest niezbędne
   do rozpatrzenia sprawy.
9. W przypadku, gdy przepisy szczególne nie stanowią inaczej, przysługują Pani/Panu prawa do kontroli przetwarzania danych, określone w art. 15-19 RODO, w szczególności prawo dostępu do treści swoich danych i ich sprostowania, usunięcia lub ograniczenia przetwarzania (o ile będą miały zastosowanie art. 17 i 18 RODO).
10. Pani/Pana dane nie będą przetwarzane w sposób zautomatyzowany, który będzie miał wpływ
    na podejmowanie decyzji mogących wywołać skutki prawne lub w podobny sposób istotnie na nią wpłynąć. Dane nie będą poddawane profilowaniu.
11. Przysługuje Pani/Panu prawo wniesienia skargi do organu nadzorczego na adres: Prezes Urzędu Ochrony Danych Osobowych

Information regarding personal data processing in the consular files

Pursuant to Article 13 of the Regulation (EU) 2016/679 of the European Parliament and of the Council (EU) of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data repealing Directive 95/46/EC (GDPR), we hereby inform that:

1. The Controller, within the meaning of Article 4(7) of the GDPR, of your personal data is the Minister of Foreign Affairs with their registered office in Poland, in Warsaw (00-580), at Al. J. Ch. Szucha 23.
2. The Consul of the Republic of Poland in Montenegro, with their registered office in Podgorica performs the duties of the controller in relation to the data included in their consular files.
3. The Minister of Foreign Affairs has appointed the Data Protection Officer (DPO), who carries out their duties in relation to data processed in the Ministry of Foreign Affairs and its foreign branches. This function is performed by Mr Daniel Szczęsny

4. Access to the data is granted to persons authorised by the Controller only.
5. The data included in the consular files are processed on the basis of the premises included in Article 6(1)(c) of the GDPR to implement the duties resulting from separate legal provisions (indicated in the table herein below) by the consul of the RP.
6. Data are protected under the provisions of the GDPR and cannot be made available to third parties who are not authorised to access these data, and will not be transferred to a third country that does not  guarantee an adequate level of protection equivalent to that provided by the provisions of the GDPR. Data may be transferred to a third country only if such a requirement is specified in Polish law or European Union law, pursuant to the provisions of Articles 44–46 of the GDPR.
7. Your data may be made available to relevant entities, including public authorities, pursuant to legal provisions. 
8. Providing your personal data by you is a statutory requirement and it is necessary to consider your case.
9. If no specific provisions provide otherwise, you have the right to control the processing of data referred to in Articles 15–19 of the GDPR, in particular the right to access your data and to rectify, erase or restrict their processing (if Articles 17 and 18 of the GDPR apply).
10. Your data will not be processed in an automated way, which will have an impact on making decisions that may have legal effects or may have a significant effect on such a decision. Data will not be profiled.
