Minister of Economic Development and Technology modifies the provisions in favour of entrepreneurs

Today, the Government looked into the draft act on conditions of permissibility of employing foreigners in the territory of the Republic of Poland. On request of the Ministry of Economic Development and Technology, the provisions on the obligatory employment contracts for the foreigners, which were extremely unfavourable and criticised by the entrepreneurs, were deleted. Also the extended control competences of the State Labour Inspection and of the Border Guard targeting the entrepreneurs employing the foreigners in Poland are to be deleted from the draft – informed Minister Krzysztof Paszyk at the press conference.

In recent year, more than 125 thousand of the Polish entrepreneurs (excluding the farmers) employed nearly 1 million of foreigners. The highest demand on employing the foreigners is recorded in agriculture, construction, transport, forwarding and logistics sector and in the industrial processing.
Today, many branches of the Polish economy, including construction, agriculture, hotel sector or industry, depend on the capacity and access to seasonal workers from around the world

No for unfavourable provisions

MEDT has reiterated that the draft contains extremely unfavourable solutions for the Polish entrepreneurs from the very onset of works on the act. Also the entrepreneurs have raised their concerns, noting that the proposed provisions may negatively affect business activity in many economic sectors, limiting their performance capacities.

The reservations were mostly made in respect to the following provisions:  

  • Introducing the rule that the permit to work for the Polish entity employing a foreigner may be granted only if the foreigner receives an employment contract.
  • Extending the list of exemptions which enable the enterprise control by the inspection authorities without the need to notify of such intent.
  • Non-refundable fee for filing a request, even if an entrepreneur, who is not in default, receives a refusal to issue a work permit or to enter the statement of employment of a foreigner into the register.
  • Determining an upper limit value of fine, which may be imposed for infringing the provisions of the act.

All amendments proposed by the Ministry of Economic Development and Technology were agreed with the representatives of competent services to acknowledge the potential threats and state security.
