Cooperation for the protection of workers. Another step towards reform of the State Labour Inspectorate

On Thursday, the third meeting of the State Labour Inspectorate (PIP) reform team took place at the Ministry of Labour. Representatives of the Ministry, the State Labour Inspectorate, the Social Insurance Institution (ZUS), the National Fiscal Administration (KAS) and the Labour Protection Council (ROP) discussed cooperation between these institutions. This is another step towards achieving a milestone of the National Reconstruction Plan.
The Minister of Family, Labour and Social Policy, Agnieszka Dziemianowicz-Bąk, emphasised that the aim of the reform of the State Labour Inspectorate is to eliminate the unlawful replacement of employment contracts with other civil-law contracts. ‘The state budget loses out on this, but it is the employee who is primarily disadvantaged in such a situation’, the minister pointed out. ‘We must ensure that the employee is not financially disadvantaged’.
The team charged with developing solutions to reform the State Labour Inspectorate is meeting for the third time within a month. It is working fast thanks to the strong involvement of the ZUS, the KAS and the PIP. ‘This is an ambitious goal, but we want to have legislative proposals ready as soon as possible’, emphasised the Director General of the Ministry of Labour, Liwiusz Laska, head of the team.
Effective collaboration and data exchange
Today's team meeting was devoted to cooperation and data exchange between the institutions - the State Labour Inspectorate, the Social Insurance Institution and the National Tax Administration - in connection with PIP inspections, but also after the labour inspector has established an employment relationship. ‘Cooperation between the three institutions will allow for more effective performance of labour inspections, as well as the implementation of decisions issued by the PIP stating the existence of an employment relationship’, said Minister Agnieszka Dziemianowicz-Bąk.
Employee protection must be effective and verifiable - and put the employee at the centre of the process. Today, the team worked to establish the rules for cooperation between the institutions so that a finding that an employment relationship exists does not burden the employee with the need to further clarify the matter before subsequent authorities. Data is to be exchanged digitally and as much as possible automatically to ensure the smooth functioning of all institutions involved in the process.
PIP reform a milestone in the National Reconstruction Plan
The reform of the State Labour Inspectorate and the creation of a procedure for converting unlawful civil law contracts into employment relationships is one of the milestones of the National Reconstruction Plan. The implementation of this reform is essential to ensure that workers are properly protected in the labour market and that Poland can access further resources from the Reconstruction Fund.
The meeting of the team charged with developing solutions to reform the State Labour Inspectorate was attended, among others, by the Chief Labour Inspector Marcin Stanecki, the President of the ZUS Zbigniew Derdziuk, representatives of the Labour Protection Council, the National Fiscal Administration and experts from the Ministry of the Family, Labour and Social Policy.
