Insurance Distribution

Rules of pursuance of insurance distribution in the scope of personal insurance and property insurance shall be set forth by Act of 15 December 2017 on insurance distribution which implemented the regulations of the directive 2016/97 of the European Parliament and of the Council on insurance distribution. Insurance distribution activities can be carried out by insurance intermediaries (insurance agents, ancillary insurance agents and insurance brokers) and insurance undertakings. An insurance intermediary shall be entered in the register of insurance intermediaries. The register of insurance intermediaries is kept by the Polish Financial Supervision Authority.

Insurance distributors have legal duty to act honesty, fairly and professionally, in accordance with the best interests of their customers. Under one of the pro-customer provisions insurance distributors shall specify, on the basis of information obtained from the customer, the demands and the needs of that customer to allow that customer to make an informed decision. The provisions of the insurance distribution act came into force on 1 October 2018.
