A comprehensive KRRiT guide for online content creators

The National Broadcasting Council (KRRiT) has prepared a new, comprehensive guide that brings together all the most important rules concerning content creators' obligations when publishing online. This material was developed in response to the needs of creators publishing video content on social media platforms.

The dynamic increase in active online activity means that more and more content creators are subject to the provisions of the Broadcasting Act. Many novice creators are unaware of their reporting obligations or the rules arising from the regulations. The new KRRiT guide organises these issues and presents them in an accessible way.

'Our goal was to prepare material that would help creators active on the internet to understand and fulfil their obligations under the regulations. The guide contains explanations and practical tips, as well as a set of reporting service forms and report submission forms. It is also one of the elements of our media and digital education campaign, which aims to co-create an informed, safe and transparent digital space’, emphasised Dr Agnieszka Glapiak, Chair of the National Broadcasting Council.

Obligations of online creators

The guide specifies, in detail, who is subject to particular obligations. These are online content creators who conduct business activities and publicly share audiovisual programmes (videos) on platforms such as YouTube, Instagram, TikTok or Facebook as part of their accounts or profiles. Please note that applications for inclusion in the list of on-demand audiovisual media services must be sent to the National Broadcasting Council (KRRiT) at least 14 days before the service is made publicly available (Article 47ca(1) of the Broadcasting Act).

However, persons who do not conduct business activities, or who conduct unregistered activities within the meaning of Article 5 of the Entrepreneurship Act (i.e. persons whose monthly income does not exceed 75% of the minimum wage), are exempt from the obligation to submit services to the KRRiT chairman.

Benefits for online content creators

The guide also reminds readers of the benefits of regulation, including entry in the National Broadcasting Council’s register and the possibility of filing complaints in the event of the unjustified blocking of copyrighted material on platforms, or the unjustified exclusion of services from European creator lists.

The guide also provides an overview of prohibited content, as well as practical tips to help you conduct your online activities safely and lawfully.
