Responsibility, Transparency, Credibility - the KRRiT's New Guide for Influencers

Around 800,000 influencers and digital creators are active in Poland today, along with hundreds of companies and organisations that work with them. With this industry in mind, the National Broadcasting Council has prepared a comprehensive guide that sets out, in accessible terms, the rules and obligations for VOD providers. The material describes, among other things, obligations relating to registration on the KRRiT list and reporting requirements, as well as standards for protecting minors and the rules for labelling adverts by influencers.

Who must register on the KRRiT list?

The guide discusses in detail matters relating to the obligation to register in the list maintained by the KRRiT. Whether such registration is required depends on the nature of the creator's activity. A creator is regarded as a provider of an on-demand audiovisual media service (VOD) if they:

  • carry out an economic activity,
  • make video material publicly available that can be watched at any time,
  • create and organise a catalogue of content (e.g. a channel, series of episodes, or playlists).

Creators who publish content purely privately, as a hobby, or irregularly are exempt from the registration requirement, as are those for whom video material is merely a supplement to their main activity. Registration is likewise not required for people carrying out unregistered business activity, provided their income does not exceed the statutory thresholds.

Transparency and reporting

A provider listed on the register must clearly inform audiences who is responsible for the content published. In a visible place on the profile, for example in the ‘About Me’ section, identification and contact details linked to the social-media profile should be included, among other things. Another important requirement is archiving removed material for at least 28 days from the date its publication ends.

Every VOD provider is required to submit an annual report on the fulfilment of their obligations by 31 March each year. In addition, they must provide financial statements or a copy of their tax return.

Protection of minors and age labelling

Any form of material benefit – whether payment, barter, discount or gift – gives material an advertising character.

The KRRiT's guide explains how to label such content correctly: clearly, unambiguously, in Polish (if the profile is run in Polish), and in a graphically distinct way. The document also includes recommendations on appropriate wording, and reminds creators of products whose advertising is legally prohibited (e.g. tobacco products or narcotic substances).

Responsible sharenting

The publication draws attention to the phenomenon of sharenting – regularly sharing images and information about children on social media. KRRiT calls for particular care over the privacy and safety of the youngest, and sets out best practices in this area.

Benefits of registering on the list

Registration on the list is free of charge and – aside from fulfilling a legal obligation – can be an important element in building a creator's credibility. Entry in the public register confirms the transparency of the activity, strengthens the trust of audiences and business partners, and provides an additional avenue of protection in the event of content being unjustifiably blocked by social-media platforms.
