Application for the Adoption or Amendment of a Local Spatial Development Plan (MPZP) Under the Simplified Procedure

In the context of local spatial development plans, for renewable energy installations other than wind installations (excluding micro wind installations), it is possible to conduct a simplified procedure, which includes:
  • Waiving the requirement to adopt a resolution on the commencement of the plan preparation process, notifying institutions and authorities responsible for agreeing and reviewing the draft plan, and submitting applications;
  • Simultaneous actions by the mayor, town mayor, or city president, who:
    • submits a request to the voivode for consent to apply the simplified procedure (14-day deadline, tacit consent),
    • requests opinions and agreements (deadline shortened to 14 days),
    • conducts public consultations (deadline shortened to 14 days, with the possibility of limiting the forms of collecting comments);
  • Informing institutions, authorities, and the public about the application of the simplified procedure, along with an explanation of the reasons for its use in the justification;
  • The possibility to continue the procedure in the event that the voivode refuses to grant consent for the application of the simplified procedure or if changes are introduced to the plan that prevent its further use.
