What you should know and who can use the service

If, as an investor, owner, or manager of a construction object, you have submitted an application for the legalization of unauthorized construction, you must provide legalization documents to the building supervision authority.

One such document is a certificate—issued by the mayor, town mayor, or city president—confirming that the construction complies with the provisions of the applicable local spatial development plan and other local legal acts. If there is no local plan or resolutions regarding the location of residential or accompanying investments, compliance is confirmed based on the decision on land development and management conditions.

The building supervision authority will notify you of the obligation to provide the certificate.

Note: If you fail to submit the required legalization documents within the deadline, the authority will issue a demolition order.

When should the matter be handled

Submit the application for the certificate as soon as possible after receiving the administrative ruling that obliges you to provide legalization documents.

After receiving the ruling, you will have no more than 60 days to submit the certificate to the building supervision authority.

Where to handle the matter

The service can be carried out at:
  • city or municipal offices
  • city offices with county rights

Submit the application to the mayor, town mayor, or city president competent for the location of the property on which the legalized construction object is situated.

If the property is located within the jurisdiction of several authorities, the matter will be handled by the authority within whose area the larger part of the property is located.

Step-by-step instructions

1. Submit an application for the certificate

You may submit the application in writing or electronically via the ePUAP inbox of the relevant city or municipal office. An application submitted online must be signed with a qualified electronic signature or a trusted profile.

Deadline

Submit the application for the certificate as soon as possible after receiving the administrative ruling that obliges you to provide legalization documents.

After receiving the ruling, you will have no more than 60 days to submit the certificate to the building supervision authority.

2. The office will verify the application in terms of formal and legal correctness

If the application has formal deficiencies, such as unpaid fees, the office will request you to correct them. You will have at least 7 days from the date of receiving the request. If you do not correct the errors within the specified time, your application will not be further processed.

3. The building supervision authority will assess the application substantively and issue the certificate

The authority will assess the compliance of the construction with the provisions of the applicable local spatial development plan and, if necessary, conduct an explanatory procedure.

If the authority confirms that the construction complies with the local plan, you will receive the certificate. If the construction does not comply with the provisions of the local spatial development plan, the authority will issue an administrative ruling refusing to issue the certificate. One reason for refusal may be the absence of an applicable local spatial development plan.

After receiving the certificate, submit it to the building supervision authority that required you to obtain it.

Fees

  • PLN 17 – stamp duty for issuing the certificate
Where to pay:
Pay the stamp duty to the account of the city or municipal office competent for the location of the office where you submit the application. You can find the account number on the website of the relevant office. For example, if you submit the application to the Poznań City Office, pay the fee to the account of the Poznań City Office.
  • PLN 17 – stamp duty for a power of attorney (optional)

If you submit a power of attorney to the office, you must pay the fee. You do not have to pay for a power of attorney granted to a spouse, children, parents, grandparents, grandchildren, or siblings.

Where to pay:
Pay the stamp duty for the power of attorney to the account of the city or municipal office competent for the location of the office where you submit the power of attorney. For example, if you submit the power of attorney to the Poznań City Office, pay the fee to the account of the Poznań City Office.

Processing time

You will receive the certificate within 7 days.

How to appeal

If you disagree with the administrative ruling refusing to issue the certificate, you may file a complaint. Submit the complaint to the competent self-government appeals board via the authority that issued the ruling. You have 7 days from the date of receiving the ruling refusing to issue the certificate.
