Entry in the Register of Bioliquid Producers

Purpose of the entry

The purpose of entry in the register of the RES bioliquid producers is to authorise a business activity involving the production of bioliquids or the generation of electricity exclusively from bioliquids in a RES installation. The entry in the register is a simplified procedure when compared to the licensing process.

When is the entry required?

Entry in the register should be made once the bioliquid production system is built, accepted and connected to the grid.

Elements of an application for the entry

The request for the entry in the register of bioliquid producers contains:

  • the identification, registered office, address and taxpayer identification number of the producer;
  • the type and scope of the business activity involving bioliquid production and the place of performing this activity;
  • the annual capacity of the bioliquid production plant or the total installed electrical capacity of the installation.

Furthermore, the following must be attached to the application:

  • a statement of the bioliquid producer that it is in no arrears with any taxes, levies and social security contributions;
  • a statement of the bioliquid producer that the data included in the application are correct and that the criteria defined in the RES Act are met;
  • proof of payment of the stamp duty;
  • if the application is submitted by an authorized representative, a power of attorney must be provided along with proof of payment of the stamp duty.

The process

The authority checks internally if the application is error-free. If the authority does not find any errors, the generator is entered in the register and the authority issues a certificate of entry in the register.

Duration of the process

The applicant is entered in the register within 7 days after the KOWR Headquarters receives a correct application along with all the statements.122

If the KOWR Director General fails to make the entry on time and more than 14 days have passed since the day the Director General received the application, the generator may commence the activity.

Authority competent for making the entry

The authority responsible for making the entry in the register of bioliquid producers is the KOWR Director General.

Entry validity period

The entry in the register has no expiry date.

What is the fee for the entry?

The stamp duty for entry in the register is PLN 616 and it must be paid at the submission of the application.

The stamp duty for an authorisation is PLN 17.

The stamp duty for a power of attorney is PLN 17.

How to appeal?

After receiving the decision, the applicant has 14 days from the date of delivery of the decision, including by public notice, to appeal against the decision to Minister of Agriculture and Rural Development. Subsequent remedies available to the investor include a complaint to the Provincial Administrative Court and, as the next step, to the Supreme Administrative Court.
