How to appeal?
If you received a visa refusal, you have the right to apply for a reconsideration of the visa application within 14 days from the date when you received the refusal decision.
To apply for a reconsideration, you do not need to register for an appointment in our online system. Simply come to the Embassy on Monday or Wednesday between 11:00 and 11:45 and submit your doccuments. If you cannot come on these days or at those times, send us an email and we will offer you an alternative date.
If the consul, after considering your application for reconsideration, issued a new decision refusing to issue a visa with which you do not agree, you have the right to appeal to the Provincial Administrative Court in Warsaw. The complaint should be forwarded through the consul who made the decision within 30 days from the date of receipt of the decision taken as a result of the reconsideration of the case. When you transfer your complaint to the consul, you do not pay any fee to the consul, but proceedings before administrative courts are subject to fees. So you have to take into account that you will be summoned by the court to pay the court fee. Information on the amount of court fees in the case of filing a complaint with the administrative court and the possibility of applying for exemption from the costs of proceedings and the language of the proceedings can be found on the following page: http://bip.warszawa.wsa.gov.pl/133/wpis-sadowy-zasady-dokonywaniawpisu.html
