Poland relies on renewable energy sources - Act on Offshore Wind Energy adopted

The Sejm has adopted, by a large majority, the Act on the Development of Offshore Wind Energy prepared by the Ministry of Climate and Environment. The new regulations eliminate investment barriers and contribute to increasing energy security by supporting the development of renewable energy sources in Poland.

Highlights:

  • On 9 October 2025, the Sejm adopted the draft Act amending the Act on the promotion of electricity generation in offshore wind farms and certain other Acts.
  • Offshore wind energy is the key component of energy transition.
  • The new regulations will facilitate the construction of wind farms in the Baltic Sea and support the development of other renewable energy sources.
  • The Act also introduces legal basis for the publication of digital RES potential maps which will indicate the most valuable areas for the location of a particular type of RES installation.

Development of the domestic offshore wind sector

The Offshore Act means levelling investment barriers and protecting consumers and the economy from uncontrolled energy price increases. It also refers to increasing energy security - reducing dependence on imported raw materials and relying on the development of Polish offshore wind energy. The Act will facilitate the development of renewable energy sources

The introduction of the Act will allow for more efficient implementation of offshore wind farm projects, as well as effective conducting of the first auction for this type of investment. The Act clarifies the regulations and eliminates legal gaps, laying a solid foundation for the successful auction and further development of renewable energy sources in Poland.

The Act will also enable, among others:

  • activity of energy cooperatives in urban municipalities, 
  • supporting the development of resident prosumer by removing the requirement to locate the installation on the building will enable the use of areas that are naturally suitable for the installation of RES installations, such as garage roofs and carports, 
  • facilitating the conclusion of contracts for the purchase of energy by LGUs within an energy cluster, 
  • meeting sustainability and greenhouse gas emission reduction criteria for biomass fuels. 

The Act also introduces, among others, legal basis for the publication of digital RES potential maps that will indicate the most valuable areas for the location of a particular type of RES installation. Ultimately, they will also allow for creation of RES Accelerated Development Areas by local authorities in consultation with local communities.

Offshore wind energy is one of the pillars of the Polish energy transition. Due to the stable conditions on the Baltic Sea - such as relatively stable and strong winds, relatively shallow depths, low salinity levels, relatively small waves and weak currents - Poland has unique opportunities to develop this sector. The plan is to reach the installed capacity of 5.9 GW by 2030 and 18 GW by 2040. This volume is included in the draft National Energy and Climate Plan up till 2030.
