Poland terminated the gas agreement on the Yamal gas pipeline

„For years, our government has consistently implemented the strategy of diversifying the sources and directions of gas supplies to Poland. After almost 30 years, on 13 May 2020, we adopted a resolution on the termination of the agreement with Russia on the construction of gas pipeline systems for gas transit through the territory of the Republic of Poland and supplies of Russian gas from Russia” – said the Minister of Climate and Environment, Anna Moskwa.

The resolution concerns the termination of the agreement on the construction of a gas pipeline system for the transit of Russian gas through the territory of the Republic of Poland and supplies of Russian gas to Poland, which was signed in Warsaw on 25 August 1993. Many annexes have been made to this agreement, with the last protocol on making amendments signed between the representatives of Poland and Russia on 29 October 2010.

The agreement was an international agreement, so the relevant note in this case has been provided by the Polish Ministry of Foreign Affairs. The document was sent on Monday. When Russia, by cutting us off from supplies, in fact violated the provisions of the agreement, the Polish government decided that due to the violation of its essential conditions, this agreement ceased to apply.

Since 2010, the operator of the Yamal gas pipeline, as well as of the entire gas transmission system in Poland, has been the Polish company – Gaz-System. Since then, the control of the Polish operator over the gas pipeline has been gradually increased, thus fulfilling the European law.

In 2022, an act was adopted determining that the operator has the right to use exclusively the assets of the owner of this network, which are necessary to perform the operator’s duties. The operator will be responsible for issuing the connection conditions, concluding and implementing an agreement for connection to this network. It will also set tariffs for gas transmission by means of this system and submit it to the President of the Energy Regulatory Office for approval. The provisions of intergovernmental agreements, as contrary to the European law, should not apply any longer.

The Head of the Ministry of Climate and Environment added that the Yamal gas pipeline operates in a manner fully compliant with the European law, without any disturbance. Thanks to this, the so-called physical reverse flow, i.e. the ability to transport gas to Poland from Germany, works without any problems, moreover, the services of natural gas transit through the territory of Poland from the East to Germany for Western European entities which decide to purchase this fuel from a Russian company are offered without any changes.
