• On 14 July 2026, the Council of Ministers adopted a draft bill prepared by the Ministry of Climate and Environment amending the Act on Renewable Energy Sources and certain other acts (UD332).
• The draft introduces an auction-based support scheme for biomethane production facilities with a capacity exceeding 1 MW.
• The new regulations will also set out the rules governing the operation of direct gas pipelines used to supply biogas, agricultural biogas or biomethane.
• The proposed measures will enable prosumers to make use of energy storage facilities more easily and will clarify the rules for energy billing.
• The draft contains amendments designed to increase the effectiveness of support schemes for renewable energy sources and to streamline the operation of energy cooperatives.

The most important element of the draft is the introduction of an auction-based support scheme for biomethane production facilities with an installed electrical capacity exceeding 1 MW. The auctions will be conducted by the President of the Energy Regulatory Office. The proposed regulations will also allow for the combination of operational support with investment support according to state aid rules.

The amendment also provides for the establishment of rules governing the operation of direct gas pipelines used to transport biogas, agricultural biogas and biomethane. This measure will increase the potential for using these fuels outside the location where they are produced. 

The draft introduces measures to streamline the investment preparation process and clarifies the rules for siting certain renewable energy installations, including those based on an integrated investment plan. It also brings the rules on public consultation into line with spatial planning regulations. 

The draft provides for changes to facilitate the use of energy storage by prosumers. The capacity of energy storage systems (subject to certain conditions) will not be included in the installed capacity of micro-installations. This will enable the use of larger energy storage systems and increase self-consumption of energy generated for personal use. The amendment clarifies the rules for presenting information on prosumer bills and for settling the prosumer deposit following a change of energy supplier. 

The draft also streamlines the operation of energy cooperatives, particularly with respect to the sharing of metering data and cooperation with energy suppliers.

The draft bill provides for a number of changes designed to increase the effectiveness of support schemes for renewable energy sources. These include, amongst other things, more favourable arrangements for modernised renewable energy installations and the possibility of considering energy produced during periods of negative prices when settling accounts under the auction system. The amendment also introduces changes to clarify and refine the existing regulations, including those concerning the definition of renewable energy installations, heat and cold storage, and the rules for certifying installers.

Once adopted by the Council of Ministers, the draft bill will be referred to Parliament for further consideration.
