The Ministry consults the first phase of the electricity market reform

On 20 August 2020, the Ministry of Climate submitted for inter-ministerial and public consultations a draft regulation of the Minister of Climate amending the regulation on the specific conditions of the power system.

The key issue of the draft is the rules of operation of the electricity balancing market, which are currently regulated in Article 6 of the Market Regulation and in the Commission Regulation (EU) 2017/2195 of 23 November 2017 establishing a guideline on electricity balancing [1] (. The Polish electricity balancing market requires reform both because of the need to adapt to the above-mentioned requirements and, especially, because of the obligations of the Republic of Poland resulting from the decision of the European Commission no. SA.46100 (2017/N) - Poland - Planned Polish capacity mechanism and from the Plan for implementation of electricity market reforms developed in accordance with Article 20 of the Market Regulation.

The implementation plan provides for a reform of the balancing market in two stages: the first stage from 1 January 2021 and the second stage from 1 January 2022.

In addition to the issues related to the functioning of the balancing market, the amendment refers to the provisions on the connection of equipment to the power grid. The need for amendment in this respect stems from the need to adapt the implementing regulations to the provisions of the Energy Law, and as regards the technical requirements for the equipment to be connected and the connections between the power systems of different countries - to the market regulation.
