The Senate unanimously passed the Act on Offshore Wind Energy

The draft bill on promoting electricity generation in offshore wind farms was unanimously adopted by the Senate. The new regulations will facilitate the construction of wind farms on the Baltic Sea and support the development of other renewable energy sources.

The Senate unanimously passed the Act on Offshore Wind Energy

Highlights:

  • The draft bill amending the Act on the promotion of electricity generation in offshore wind farms and certain other acts was unanimously adopted by the Senate on 16 October 2025. 
  • Offshore wind energy is the key element of Poland's national energy strategy. 
  • The new regulations eliminate investment barriers and contribute to increasing energy security by supporting the development of renewable energy sources in Poland. 

The introduction of the Act will enable streamlining of the implementation of offshore wind projects and efficient conduct of the first auction for offshore wind farms and other renewable energy sources. The Act clarifies the regulations and fills legal gaps to ensure that the auction is successful.  

The draft bill will enable, in particular:  

  • operation of energy cooperatives in urban municipalities,  
  • support for the development of resident prosumers,  
  • facilitation of energy purchase agreements by local government units within the framework of energy clusters,  
  • the fulfilment of sustainable development criteria and criteria for reducing greenhouse gas emissions from biomass fuels.  

The Act also introduces, among others, legal basis for the publication of digital RES potential maps that will indicate the most valuable areas for the location of a particular type of RES installation. Ultimately, they will also allow for creation of RES Accelerated Development Areas by local authorities in consultation with local communities. 

Offshore wind energy is one of the pillars of the Polish energy transition. Due to the stable conditions on the Baltic Sea - such as strong winds, shallow depths and low salinity – Poland has unique opportunities to develop this sector. The plan is to reach an installed capacity of 5.9 GW by 2030 and 18 GW by 2040. This volume is included in the draft National Energy and Climate Plan until 2030.  

The most advanced offshore wind project in Poland is the Baltic Power project (with the capacity of almost 1,200 MW). The project is expected to be fully operational in the second half of 2026. The second project is the Baltica 2 offshore wind farm project (with the capacity of almost 1,500 MW). The start-up date is scheduled for the second half of 2027.
