The System of Technical Support

The President of the National Atomic Energy Agency (hereinafter the President of PAA) in the scope of activities related to the supervision of nuclear power plants may use only authorized laboratories and expert organizations. These activities include:

  1. assessment of an application for obtaining a license for construction, commissioning, operation or decommissioning of nuclear power plant;
  2. carrying out inspections in a nuclear power plant, referred to in art. 65a para. 1 of the Atomic Law;
  3. issuing a general opinion on the planned organizational and technical solutions referred to in art. 39b of the Atomic Law;
  4. issuing a preliminary opinion regarding the planned site referred to in art. 36a of the Atomic Law;

As soon as the President of PAA decides that, as part of the above activities, support from an authorized laboratory or an expert organization is necessary, a public procurement procedure will be initiated in accordance with the principles set out in the Act - Public Procurement Law (https://www.uzp.gov.pl/baza-wiedzy/prawo-zamowien-publicznych-regulacje/prawo-krajowe/ustawa-pzp-obowiazujaca-od-1.01.2021-r.). Authorization of the PAA President will be one of the requirements included in the specification of essential terms of the contract.

Laboratories and expert organizations interested in obtaining the authorization of the President of PAA, may submit an application for authorization in a specific scope, with attachments confirming compliance with the requirements set out in the Act - Atomic Law. The application may be submitted by both domestic and foreign entities.

The Scope of Technical Support

The entity submitting the authorization application must specify its scope. It is recommended that it should be connected to topics related to the safety of nuclear power plants and useful for the President of PAA in the course of activities necessary for performing a regulatory assessment as well as supervision and inspections in this respect. A list of authorization topics suggested currently by the President of PAA is available below (see list of useful documents). Laboratories and expert organizations may also propose their own scope of expertise or combine two or more fields indicated on the list in the application for authorization.

Requirements for obtaining authorization

In accordance with article 66a para. 1 of the Act –Atomic Law, the authorization shall be awarded to expert laboratories and organizations which comply with the following requirements:

  1. they are not:
  1. designers, producers, suppliers, fitters/installers or
  2. representatives of entities engaged in design, construction or operation of a nuclear power plant
  3. financially or organizationally connected with entities mentioned above in points a. and b.,
  1. have at disposal necessary personnel and equipment necessary for performing tasks related to the scope of the proposed authorisation,
  2. the personnel has necessary knowledge and experience in the area of the proposed authorisation;
  3. guarantee performing impartial assessment;

 

Requirements with respect to the application for granting authorization or change in the scope of authorization

The application for authorization or change in the scope of authorization in accordance with the Atomic Law shall include:

  1. name and address of the applying entity, telephone number, fax number, and e-mail address;
  2. scope of authorization applied for or scope of change in the existing authorization;

Additional requirements and information

  1. The application should include attachments comprising detailed information and documents confirming that the statutory requirements have been met.
  2. A complete application pursuant to Art. 5 of the Polish Language Act, must be drawn up in Polish. It is permissible to attach publications, expert opinions or other documents in English to the application, with a concise description and scope in Polish.
  3. It should be clearly specified which of the provided information or attached documents are proprietary due to confidential information or trade secrets content. In accordance with paragraph 4 of the Unfair Competition Law, a trade secret is understood as technical, technological, organizational information of a company or other information of economic value, undisclosed to the public, for which the entrepreneur has taken the necessary steps to maintain their confidentiality.
  4. The completed and signed application with relevant attachments should be submitted in person, via the ePUAP electronic inbox or sent to the President of PAA (ul. Bonifraterska 17, 00-203 Warszawa). When submitting the above in person or by post, it is recommended to include the attachments to the application in electronic form on a data carrier and to number the attachments in accordance with the indications in the application.
  5. The application is subject to stamp duty.

The process of obtaining the authorization or changing its scope

  1. Submission of an application by a laboratory or expert organization to the President of PAA.
  • It is permissible to include multiple scopes of authorization in one application.
  • When submitting the application, it is possible to use an application template available below.
  1. Before issuing an administrative decision on authorization, the President of PAA:
    • evaluates the documents submitted by the applicant;
    • may conduct a preliminary inspection at the applicant's in order to verify compliance with the requirements referred to in para. 1 Art. 66a of the Act - Atomic Law.
  2. The PAA President grants authorization or change of its scope, or refuses to grant authorization by way of an administrative decision. This decision specifies the scope and duration of the authorization.
