Amendment to the Act of 12 March 2022 on assistance to Ukrainian citizens in connection with the armed conflict on the territory of the country

Works are underway on a draft law amending the act on assistance to Ukrainian citizens in connection with the armed conflict on the territory of the country and certain other laws. One of the changes envisaged by this draft is the repeal of the provision of Article 38 of the Act of 12 March 2022 on assistance to Ukrainian citizens in connection with the armed conflict on the territory of the country (JoL item 583, as amended), providing for the possibility to apply, after 9 months of entry, for a temporary residence permit.

It would be premature to start the process of submitting applications under Article 38 and their processing by the voivodes under the current conditions, i.e. the still ongoing armed conflict on the territory of Ukraine and the possibility of using the institution of temporary protection.

The draft law contains a transitional provision pursuant to which the voivode will leave unprocessed the applications submitted pursuant to the repealed provision of Article 38 of the above-mentioned act during the period from 24 November 2022 until the date of entry into force of the amending Act.

Ukrainian citizens will continue to enjoy the existing rights provided by the above-mentioned law.
