A Polish employer hired a foreign national who has been granted a visa and a work permit, has came to Poland but has refused to take up the employment. Is there anything the employer is required to do?

Art. 88i of the Law on the Promotion of Employment and on the Labor Market requires the employer to notify in writing the Province Governor who had granted the work permit that the foreign national has not taken up the employment within 3 months from the start date of the work permit, has quit the employment before the end date of the permit or has interrupted the employment for a period longer than 3 months. The notice should be given within 7 days from the “trigger date”.
