The governmental law making process

The governmental law making process consists of all activities related to the preparation by the government’s administration of draft legal acts (including laws and regulations) together with their justifications and the assessment of the anticipated effects of their implementation (the so-called regulatory impact assessment). These activities include:

Public consultations

The aim of public consultations is to take into account the views of stakeholders in the law making process. The most important benefits of public consultations are:

  •  better recognition of the various groups of recipients’ position as far as the proposed solution is concerned,
  • improvement of the solution being the subject of consultations,
  •  new solutions proposed,
  • disseminating information about the activities carried out and greater social acceptance

The rules for conducting public consultations are set out in the Guidelines for conducting impact assessment and public consultations within the government legislative process.

Who and how can take part in the public consultation?

All documents relating to the work on drafts are available in the Public Information Bulletin of the Government Legislation Center in the tab Government Legislative Process (RPL). Each citizen can read the draft legal acts and submit comments to them.

In addition to making the draft available in the Government Legislative Process tab, information on public consultations may be sent by the ministry in writing to stakeholders, other interested entities or institutions. In order to support administrative bodies in the selection of stakeholders to consult on specific draft legal acts, the Ministry of Economic Development and Technology maintains a list of entities to be used in the process of public consultations on draft legal acts, with particular emphasis on organizations representing entrepreneurs. The list of entities is used by ministries and offices that carry out legislative work and conduct public consultations. Invitations to participate in consultations may be sent to the entities on the list. The list is an open directory.
