Steps in the investment process for implementing this system
The investment path for micro-scale systems using biomass has been significantly shortened compared to larger-capacity systems of this type. However, it still requires, among other things, obtaining a construction permit.
Step 1 – Spatial planning
In the Polish legal framework, the most important instruments are: Local Spatial Development Plans (MPZP), and for areas not covered by these plans, during the transitional period following the entry into force of the spatial planning reform (Act of 7 July 2023 amending the Act on Spatial Planning and Development and certain other acts), decisions on land development conditions. An additional solution introduced by the reform is the Integrated Investment Plan (ZPI).
Step 2 – Obtaining a construction permit
The construction permit is an element of the investment process that forms the basis for commencing construction works on the biomass system. Without this decision, construction works cannot begin, nor can the system be put into operation.

Step 3 – Operational notification
An operational notification will be required for biomass systems that, under the Building Law, are classified as buildings. In such cases, they fall under category XVIII of the annex to the Building Law, and their use must be preceded by obtaining an operational notification.
Other cases requiring an operational notification include situations where the investor intends to use part of the system before completing all construction works, or when legalizing unauthorized construction.

Step 4 – Micro-system notification / obtaining conditions for connection
If the capacity of the micro-system is less than or equal to the connection capacity of the building on which it will be installed, a notification of connection to the grid is submitted. The operator connects the system within 30 days from the date of notification.
If the connection capacity of the micro-system exceeds the connection capacity of the building on which it is installed, an application for issuance of conditions for connection is required.
