W dniu 7 października 2025 r. Trybunał Arbitrażowy orzekający na podstawie Traktatu o stosunkach handlowych i gospodarczych, zawartego pomiędzy Rzecząpospolitą Polską a Stanami Zjednoczonymi Ameryki, w postępowaniu administrowanym przez Stały Sąd Arbitrażowy w Hadze (Permanent Court of Arbitration), wydał wyrok, w którym uznał zasadność zarzutu podnoszonego przez Rzeczpospolitą Polską i stwierdził brak swojej jurysdykcji ratione personae do rozpoznania sprawy wniesionej do arbitrażu przez dwie osoby fizyczne posiadające podwójne polskie i amerykańskie obywatelstwo. Trybunał uznał, że w sprawie konieczne było zastosowanie testu dominującego i efektywnego obywatelstwa wynikającego z międzynarodowego prawa zwyczajowego i stwierdził fakt posiadania przez powodów, w chwili wszczęcia postępowania arbitrażowego, efektywnego i dominującego polskiego obywatelstwa.

Rzeczypospolita Polska była reprezentowana w postępowaniu arbitrażowym przez zespół radców PGRP z Departamentu Prawa Międzynarodowego i Europejskiego.

 

On 7 October 2025, the Arbitral Tribunal ruled in favor of Poland in proceedings based on the Treaty on trade and economic relations between Poland and the US, in proceedings administered by the Permanent Court of Arbitration in The Hague. The award upheld the objection raised by the Republic and declared that the Tribunal lacked jurisdiction ratione personae to hear the case brought to arbitration by two natural persons holding dual Polish and American nationality. The Tribunal applied the test of dominant and effective nationality under customary international law and concluded that, at the time the arbitration proceedings were initiated, the claimants had dominant and effective Polish nationality.

Poland was represented in the arbitration proceedings by a team of counsel from the Department of International and European Law at the General Counsel to the Republic of Poland (Prokuratoria Generalna).
