Legal grounds

Over the years, the requirements and principles of the EMAS operation in the European Union have been defined by way of successively adopted regulations concerning the participation of organizations in the eco-management and audit scheme in the Community.

The European Commission and the Member States drafted an amendment to Regulation (EC) No 1221/2009 of the European Parliament and of the Council of 25 November 2009 on the voluntary participation by organizations in a Community eco-management and audit scheme (EMAS), also known as EMAS III, that was published on 22 December 2009 in the Official Journal of the European Commission L 342 (Vol. 52). EMAS III entered into force on 11 January 2010.

In Poland, EMAS operates under (apart from the Regulation itself) the Act of 15 July 2011 on the national eco-management and audit scheme (EMAS) (Journal of Laws of 2011, No. 178, item 1060), as well as implementing acts of the Minister of the Environment:

  • Regulation of the Minister of the Environment of 23 March 2012 on the coefficients differentiating the amount of the registration fee for entry in the register of organizations registered in the national eco-management and audit scheme (EMAS) (Journal of Laws of 2012, No. 0, item 341),
  • Regulation of the Minister of the Environment of 1 February 2012 on the model application for registration of an organization in the EMAS register (Journal of Laws of 2012, item 166).

The national EMAS consists of:

  • minister competent for the environment,
  • General Director for Environmental Protection,
  • Polish Center for Accreditation.

Pursuant to the aforementioned act, the minister competent for the environment implements a policy regarding the system development and cooperates with the European Union authorities.
The powers of the General Director for Environmental Protection include:

  • keeping a register of organizations registered in EMAS,
  • providing organizations, upon a written request, with the information referred to in Article 32(1) and (2) of Regulation (EC) No 1221/2009.
