Information on the rules for applying for a refund of fees paid to the university in the event of failure to obtain a visa to enter Poland for the purpose of commencing or continuing studies

20.10.2026

The rules for charging fees for educational services by public universities are specified in the provisions of the Act of 20 July 2018 – Law on Higher Education and Science. In the case of non-public universities, these matters are regulated by internal regulations in force at the respective university.

All financial matters and the detailed terms and conditions of study are set out in a contract concluded directly between the university and the candidate or student. This document specifies, among other things, the amount of fees, the deadlines for their payment, and the rules for a potential refund of funds.

Before signing the contract and making a payment, it is advisable to read the document carefully. Particular attention should be paid to the provisions governing the refund of fees paid in the event of withdrawal, failure to enrol or inability to commence studies.

The Ministry of Science and Higher Education is not a party to these contracts and does not have the legal competence to:

  • review applications for the refund of fees and make decisions on such matters;
  • obligate or order universities to refund these fees;
  • resolve disputes arising from contracts between the candidate or student and the university.

All matters and disputes regarding fees must be directed directly to the authorities of the respective university.

In the event of the university's failure to comply with the provisions of the contract, in particular where it has failed to make a refund despite the conditions set out in the contract being met, claims may only be pursued through civil proceedings.

Individuals who consider that the university has failed to meet its contractual obligations may assert their rights before a competent civil court, in accordance with applicable laws or, where appropriate, through relevant consumer protection mechanisms and institutions.
