New rules of hiring foreigners

The Council of Ministers adopted a draft Act amending the Act on the promotion of employment and labour market institutions and some other acts, submitted by the Minister of Family, Labour and Social Policy.

The draft amendment to the Act defines new rules for hiring foreigners to perform seasonal and short-term work in Poland. The basis for the exchange of data on work performed by foreigners between offices was also created.

 

The proposed changes are to prevent abuses in the employment of foreigners based on statements and, in particular, their registration despite the lack of possibility and intention of employing foreigners (so-called trade in statements). Many people do not undertake work in Poland and most likely, go to other European Union countries, using the statement and Polish visa issued on that basis to stay in the Schengen area for 90 days.

 

The provisions introduced align national law with the EU directive on the conditions of entry and residence of third-country nationals (non-EU) as regards employment as seasonal workers.
